Insurance Claims for NYC Car Accidents

New York City Car Accident Lawyer

If you have been involved in a car accident in New York City, you may have questions about filing an insurance claim so you can get money for your medical expenses. At Hochheiser & Hochheiser LLP we have the experience and resources to properly address your insurance claim in order to help you seek the full compensation to which you may be entitled. We represent clients in Manhattan and throughout NYC and are ready to see how we can help you seek a positive outcome for your claim.

About Car Insurance Claims

In New York, auto insurance is based upon a "no-fault" system. A driver, passenger, pedestrian or bicycle rider involved in any type of auto accident may seek compensation from their own insurance company if they were driving or from the insurance company of the driver whose vehicle they were in (if the victim was a passenger) or from the vehicle that struck them (if the victim was a pedestrian/cyclist). Medical expenses and lost wages are paid on a no-fault basis, meaning the victim does not need to prove that the other party was at fault in order to recover a settlement.

You only have 30 days from the date of your accident to file a no-fault insurance claim. If you do not file your claim in time, you may lose your right to compensation.

Though car accident insurance claims are handled on a no-fault basis for the most part, this does not mean that you will be barred from suing the responsible party for emotional damages or other compensation that is typically not covered. For catastrophic and fatal car accidents, you may have the right to take legal action. An attorney at our NYC law firm can review the particular circumstances of the incident and can help by:

  • Determining what insurance company you should bring a claim against;
  • Determining whether you may have the right to sue for additional damages; and
  • Properly presenting your claim to the insurance company (including handling any negotiations or taking your case to court) to seek a fair settlement on your behalf.
