A 68-year-old hot dog vendor claimed that he was struck by a vehicle driven by Telez as he was pushing his motorized vehicle across five lanes of moving traffic at the intersection of W. 39th Street and 10th Avenue in Manhattan. Plaintiff suffered a closed head injury with loss of consciousness and was hospitalized for five days. As a result, plaintiff suffered permanent cognitive difficulties requiring round-the-clock home care
